These Terms of Use ("Terms") are an agreement between you and the operator of VisitIO ("VisitIO", "we", "us"). By creating an account or using the app you agree to these Terms and to the Privacy Policy. If you use VisitIO on behalf of a business, you confirm you are authorised to bind that business.
1. What VisitIO is
VisitIO is a field-documentation tool for tradespeople and service businesses. It lets you photograph work, record and transcribe voice notes, write notes and priced items, capture client signatures, and produce PDF reports and estimates. Optional paid features add scheduling, payment collection aids and syncing with your phone's calendar and contacts.
VisitIO is a tool. We do not perform, inspect, warrant or take responsibility for the work you document, the prices you quote or the payments you collect.
2. Your account
You may use VisitIO without an account (data stays on your device) or sign in with email or Google to back up and sync across devices. Keep your credentials secure; you are responsible for activity under your account. You must be at least 18, or the age of majority where you live.
3. Your content and your clients' data
Everything you enter or capture (photos, notes, recordings, transcriptions, contact details, signatures, prices) is your content. You keep all rights to it and grant us only the licence needed to store, process, back up, display and transmit it so the service works for you.
You collect personal information about your clients (names, addresses, phone numbers, emails, images of their property, signatures). For that data you are the data controller or business, and VisitIO acts on your instructions as a processor or service provider. You are responsible for:
- having a lawful basis and, where required, consent to collect it;
- telling clients how you use their information;
- using it only to deliver, document and invoice your services;
- not using it for unsolicited marketing or sharing it beyond what the job requires;
- keeping your device secure and honouring your clients' access, correction and deletion requests;
- complying with the privacy laws that apply to you (for example GDPR/UK GDPR, PIPEDA and provincial laws in Canada, LGPD in Brazil, CCPA/CPRA and other state laws in the United States).
The separate "Client Data Responsibilities" notice summarises these obligations and forms part of these Terms.
4. Acceptable use
Do not use VisitIO to break the law, infringe others' rights, harass anyone, record people without a legally required notice or consent, upload malware, or attempt to access other users' data or our systems without authorisation.
5. Third-party services
VisitIO relies on third parties: Google (Firebase authentication and database, Google Play Billing and Play services on Android), Apple (App Store billing and Sign in with Apple on iOS), Stripe (card payments when you connect a Stripe account), Cloudflare (media storage) and OpenAI (voice-note transcription and Ask AI). Payment methods you configure (card payments through Stripe, checkout links, Venmo, Zelle, Interac e-Transfer, Pix, SPEI, PayID, bank transfer, cash) are provided by those services or your bank; VisitIO only displays the details and QR codes you configure and never holds or moves money. Their terms apply to your use of them.
6. Subscriptions
VisitIO Pro (which includes Ask AI) is a monthly or yearly subscription purchased through the store you installed VisitIO from: Google Play on Android or the Apple App Store on iOS (the “store”). Prices are shown in the store for your country before you buy. Subscriptions renew automatically until cancelled in the store's subscription settings. Refunds are handled under the store's policies. Prices may change; you will be notified through the store before a change affects you.
7. Availability and changes
We may change, suspend or discontinue features, and we may update these Terms. If a change is material we will ask you to accept the new version in the app. Continued use after that constitutes acceptance.
8. Account deletion
You can delete your account in Settings. Your account and cloud data are permanently deleted 30 days after the request unless you sign in again within that period. Data on your device is removed immediately.
9. Disclaimers
VisitIO is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, including fitness for a particular purpose and non-infringement. We do not guarantee transcription accuracy, uninterrupted availability or that stored content will never be lost — keep your own copies of important reports.
10. Limitation of liability
To the extent permitted by law, VisitIO is not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or business, arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some jurisdictions do not allow these limitations, in which case they apply to the extent permitted.
11. Termination
You may stop using VisitIO at any time. We may suspend or terminate accounts that violate these Terms. Sections 3, 9, 10 and 12 survive termination.
12. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which the VisitIO operator is established, without regard to conflict-of-law rules, and disputes will be brought in its courts, unless the consumer-protection law where you live gives you additional rights that cannot be waived.
